Adjustment of Status

The processing time for IR-1 and CR-1 visa can be considered almost double the period for K3 visa. The reason behind is most probably due to the fact that IR-1 and CR-1 visa undergoes consular processing before it may be issued.

Moreover, before the National Visa Center may give due course to the IR-1 or CR-1 Visa application, the status of the case needs to become current first or only when the filing date reaches or is near the qualifying date. On the other hand, the K3 applications are can be immediately processed by NVC and be forwarded to the appropriate US embassy.

The K3 visa has shorter processing time but the holder still has to go through Adjustment of Status in the US. The course for the adjustment may take approximately six months which is quite a long time. However, the good thing here is that the alien spouse is already in the US while waiting for the result. In addition, the K3 visa is also a multiple entry visa.

He or she may still go back to his home country anytime. Nevertheless, he or she has to come back within the prescribed period in order to avoid presumption of abandonment of application to arise.
